Last week, Don Stine, reporter at the Coaster, reported that two condominium associations in Ocean Grove had filed a suit against the OGCMA because they believe that the land lease fee (“ground rent”) agreements are illegal and/or invalid.
The lawyer on the case is James T. Hundley of OG, and the plaintiffs are the 22 unit Pathway Condominium Association at 30 Ocean Pathway and the 6 unit Dardanelle Condominium Association at 40 Ocean Pathway. Note that there are 26 condo associations in OG.,

According to the court docket sheet (Pathway Condo Assoc v OCGMA, MON-L-0313-17), this case was dismissed by the court about 3 months after it was filed. On March 2, 2017, the OCGMA filed a “motion to dismiss” – which is a legal document saying to the court there is no legal basis on which this case can proceed so it should end now. The Court apparently agreed and on March 31, 2017 entered an order dismissing the case. The court documents are not electronically available, so I cannot see the substance of the papers, but procedurally that is what happened.
