After the Historic Preservation Commission (HPC) refused to grant OGNED a Certificate of Appropriateness for the North End project, OGNED sued. But whom did they sue? The HPC?
We have learned from a source that OGNED sued Neptune Township and George Waterman. Mr. Waterman is the Zoning Officer who works under Bernard Haney, the Tax Assessor.
Why did OGNED sue Neptune and Waterman? Who knows, but they say you can sue a ham sandwich if you wish. I don’t eat ham, but how about suing a potato knish?
Evidently OGNED asked the court for summary judgement, but that didn’t happen, and Neptune asked the court for dismissal in lieu of filing an answer.
What does that mean? I have no idea, but the melody lingers on.
Could this suit be some sort of legal trickery to create an end-run around the HPC?
What I do know is that only the HPC can grant what OGNED wants, so let’s wait and see.
My legal source is following this and says, “It won’t be pretty.”
10/10/24: The Township settled the suit and will allow OGNED to bypass the HPC.
But, wait a minute: Today a letter to the Coaster from Barbara Burns announces that she and her friends will raise money to fight for We-The People.
